These Terms of Service ("Terms") govern your access to and use of thepunchlistdaily.com, the The Punch List Daily email newsletter, our text-message program, our polls, contests, and forms, and any other content or services we provide (together, the "Service"), operated by LOP Solutions, LLC d/b/a The Punch List Daily ("The Punch List Daily," "we," "us," or "our"). By using the Service, subscribing to any of our messaging programs, or submitting anything to us, you agree to these Terms and to our Privacy Policy and SMS Terms. If you do not agree, do not use the Service.

The Service is intended for people who work in or around the trades and for people at least 18 years old. By using the Service or subscribing to any messaging program you represent that you are 18 or older, that the information you provide is accurate and current, and that the email address and mobile number you provide belong to you or that you are authorized to use them. We may refuse, suspend, or terminate access to anyone at any time, for any reason, without notice.
The Punch List Daily is a free editorial publication: news, opinion, polls, memes, and sponsor offers for the trades. It is provided for general information and entertainment. Nothing on the Service is legal, safety, code-compliance, tax, financial, medical, employment, or other professional advice, and nothing is a guarantee of any result. Regulations, codes, wages, prices, and product specifications change and vary by jurisdiction. Any figures, examples, stories, or comparisons — including reader-submitted content and poll results — are illustrative, not promises or recommendations. You are responsible for decisions you make on the job, in your business, and with your money. Confirm anything that matters with the applicable agency, your licensed professional, or the manufacturer.
By providing your email address you agree to receive the The Punch List Daily newsletter and related editorial and promotional email from LOP Solutions, LLC. Our emails include sponsor messages and advertising. Every email contains a one-click unsubscribe link and our physical mailing address as required by the CAN-SPAM Act. You may unsubscribe at any time; requests are processed within 10 business days and usually immediately. We may still send you transactional or service messages (for example, confirming an opt-out or responding to a request you made).

The Service is supported by advertising and sponsored messages. Sponsored content is labeled where required. We do not endorse, guarantee, or take responsibility for any product, service, claim, or offer made by an advertiser or sponsor, and we are not a party to any transaction between you and a third party. Any purchase you make from a third party — including anything reached by clicking a link in our emails, texts, or articles — is governed solely by that third party's terms and policies, and any dispute is between you and them. Some links may be affiliate links; we may be compensated when you click or buy.
Polls are unscientific and for entertainment. Where we run a contest, sweepstakes, or giveaway, the official rules posted with it govern, no purchase or SMS consent is ever necessary to enter, and void where prohibited. We may disqualify entries we reasonably believe are fraudulent, automated, or in violation of these Terms.
If we offer paid products, memberships, or services, the price, delivery, and refund terms shown at the point of purchase apply and are incorporated into these Terms. Prices are in U.S. dollars and may change at any time without notice to previous buyers. Unless stated otherwise at purchase, digital products are licensed to you personally, non-exclusively, and non-transferably, and may not be resold, shared, or redistributed.
The Service — including all articles, headlines, images, memes, graphics, logos, the "The Punch List Daily" name and mark, and the site's design and code — is owned by LOP Solutions, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may link to our articles and quote short excerpts with attribution and a link back. You may not republish, scrape, frame, mirror, or redistribute full articles, images, or any part of the Service, or use our name or marks, without our prior written permission. Nothing in these Terms transfers any ownership to you. Feedback or suggestions you give us may be used without any obligation to you.
If you send us a tip, comment, poll response, photo, video, meme, story, or other material ("Submission"), you grant LOP Solutions, LLC a perpetual, irrevocable, royalty-free, worldwide, sublicensable license to use, copy, edit, publish, distribute, and create derivative works from it in any media, with or without attribution, and you waive any moral rights to the extent permitted by law. You represent that you own or have the rights to the Submission, that it does not infringe or violate anyone's rights, and that it is not defamatory, unlawful, or misleading. We may remove or decline any Submission for any reason. Do not send us confidential information.
You agree not to: (a) copy, scrape, crawl, frame, or mirror the Service or its content, or use it to train automated systems, without our written consent; (b) harvest or collect email addresses, phone numbers, or other information about other users; (c) send spam or use the Service to violate any telemarketing, text-messaging, or privacy law; (d) attempt to bypass any security, rate limit, or access control, or access accounts, data, or systems you are not authorized to use; (e) upload malicious code or interfere with the operation of the Service; (f) misrepresent who you are or your affiliation with anyone; (g) submit false, defamatory, threatening, or infringing content; or (h) use the Service for anything unlawful. We may investigate, suspend, terminate, and report violations without notice.
The Service relies on third parties such as web hosting, email and SMS delivery providers, our customer-relationship and messaging platform, chat tools, payment processors, advertising networks, and social platforms. We are not responsible for their availability, acts, or omissions, and your use of them is subject to their own terms and privacy policies. Links to other sites are provided for convenience; we do not control or endorse them.
THE SERVICE, INCLUDING ALL CONTENT, EMAILS, AND TEXT MESSAGES, IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, LOP SOLUTIONS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT ANY EMAIL OR TEXT WILL BE DELIVERED, OR THAT ANY RESULT WILL BE ACHIEVED. Some states do not allow certain disclaimers, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, LOP SOLUTIONS, LLC, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, SPONSORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, OR FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO THE SERVICE OR ANY CONTENT, ADVERTISEMENT, OR THIRD-PARTY OFFER, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless LOP Solutions, LLC, its affiliates, and their owners, members, officers, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your Submissions, your violation of these Terms, or your violation of any law or third-party right — including any telemarketing, text-messaging, or privacy law.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at foreman@thepunchlistdaily.com with a written description of the issue and give us 30 days to try to resolve it informally. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to their personal jurisdiction and venue. To the extent permitted by law, each party waives any right to a jury trial, and agrees that claims may be brought only individually — not as a plaintiff or class member in any purported class, collective, or representative proceeding. Any claim must be filed within one (1) year after it arises or it is permanently barred. Nothing in this section limits any non-waivable rights you may have under the TCPA or other consumer-protection laws.
We may change, suspend, or discontinue any part of the Service at any time without liability. We may update these Terms by posting a revised version with a new effective date; changes take effect when posted, and continued use of the Service after that means you accept them. Material changes to the email or text-message programs will be announced by email or text before they take effect.
You consent to receive notices and communications from us electronically (by email, text where you have opted in, or by posting on the Service), and you agree that electronic notices satisfy any legal requirement that a communication be in writing. Notices to us must be sent to the address in Section 19.
These Terms, our Privacy Policy, our SMS Terms, and any rules or terms posted with a specific offer are the entire agreement between you and LOP Solutions, LLC regarding the Service and supersede any prior understanding. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them freely, including in connection with a merger, acquisition, or sale of assets. Sections 9 through 19 survive any termination.
