Privacy Policy

The Punch List Daily (the "Site," "we," "us," or "our") is a publication of LOP Solutions, LLC. This Privacy Policy explains what information we collect when you visit the Site or subscribe to our email or text-message programs, how we use it, who we share it with, and the choices you have. By using the Site or subscribing, you agree to this Policy.

2. Information We Collect

Information you give us. When you subscribe, enter a poll, or contact us, we may collect your first name, email address, mobile phone number, your trade or occupation if you tell us, and the content of any message you send us.

Information collected automatically. When you visit the Site we collect standard server-log data: IP address, browser and device type, operating system, referring URL, pages viewed, and timestamps. We may use cookies and similar technologies (see Section 7).

Engagement data. For emails and text messages we send, we may record whether a message was delivered, opened, clicked, replied to, or bounced, so we can measure what's working and stop sending to people who don't want it.

3. How We Use Your Information

• To send you the The Punch List Daily email newsletter you signed up for.
• To send you text messages (SMS/MMS) only if you have separately opted in to our text-message program (see Section 5).
• To respond to your questions, tips, and requests.
• To run polls and report results.
• To operate, secure, and improve the Site and our messaging programs.
• To comply with law and enforce our Terms of Service.

4. Email Program

By providing your email address you consent to receive the The Punch List Daily newsletter and related editorial and promotional email from us. We comply with the CAN-SPAM Act. Every email we send includes our physical mailing address and a working one-click unsubscribe link. Unsubscribe requests are honored within 10 business days (usually immediately). You may also unsubscribe by emailing foreman@thepunchlistdaily.com.

5. Text-Message (SMS/MMS) Program

We operate an opt-in text-message program under the name The Punch List Daily. Full program terms are at /sms-terms/. In summary:

• Consent. You will only receive text messages from us if you expressly opt in by providing your mobile number and agreeing to receive texts (for example, by checking the SMS consent box on a signup form or texting a keyword to our number). Consent to receive text messages is not a condition of any purchase or of receiving the email newsletter.
• Message frequency varies. Message and data rates may apply.
• Opt out at any time by replying STOP to any message. You will receive one final confirmation text. For help, reply HELP or email foreman@thepunchlistdaily.com.
• We do not sell, rent, or share your mobile phone number or SMS opt-in status with third parties or affiliates for their marketing or promotional purposes. Mobile information is used solely to operate our own text-message program and is shared only with the service providers that help us send messages (see Section 6).
• We keep a record of the date, time, source, and method of your opt-in (and any opt-out) as proof of consent.

6. How We Share Information

We do not sell your personal information. We share it only:

• With service providers who act on our behalf and are bound to protect it — for example our email service provider, SMS/messaging platform and carrier aggregators, hosting provider, and analytics tools. These providers may only use your information to perform services for us.
• With advertisers and sponsors, in aggregate only. We may tell a sponsor "a message went to 40,000 readers and 12% clicked." We do not give sponsors your name, email, or phone number.
• For legal reasons — to comply with a subpoena, court order, or other legal process; to protect our rights, property, or safety or that of our readers; or to investigate fraud or abuse.
• In a business transfer — if LOP Solutions, LLC or The Punch List Daily is sold, merged, or transferred, your information may transfer with it, subject to this Policy.

Text-message opt-in data and mobile phone numbers are never shared with third parties or affiliates for marketing purposes under any of the above.

7. Cookies and Tracking

We use first-party cookies for basic site functionality and to remember your preferences. We may use third-party analytics (such as Google Analytics) and advertising pixels (such as the Meta Pixel) to understand traffic and measure campaigns. These tools may set their own cookies subject to their own policies. You can control cookies through your browser settings; disabling them may affect some Site features. We do not respond to browser "Do Not Track" signals at this time.

8. Data Retention

We keep subscriber information for as long as you remain subscribed and for a reasonable period afterward to honor opt-outs and satisfy legal record-keeping obligations. We retain SMS consent and opt-out records for at least four years as required by TCPA-related guidance. Server logs are retained for no more than 90 days unless needed for a security investigation.

9. Your Choices and Rights

• Email: click "unsubscribe" in any email, or email us.
• Text messages: reply STOP to any text, or email us.
• Access, correction, deletion: email foreman@thepunchlistdaily.com and we will tell you what we hold about you, correct it, or delete it, within 30 days (subject to records we must keep by law, such as opt-out logs).

10. California and Other State Privacy Rights

If you are a resident of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, or another state with a comprehensive privacy law, you may have the right to know what personal information we collect, to access or delete it, to correct it, and to opt out of its "sale" or "sharing." We do not sell personal information and do not share it for cross-context behavioral advertising. To exercise any right, email foreman@thepunchlistdaily.com with "Privacy Request" in the subject line. We will verify your identity using the email address or phone number on file and respond within 45 days. We will not discriminate against you for exercising your rights.

11. Children

The Site and our messaging programs are intended for adults age 18 and older working in or interested in the trades. We do not knowingly collect personal information from anyone under 13 (or under 16 where applicable). If you believe a minor has provided us information, email us and we will delete it.

12. Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encrypted connections (HTTPS) and access controls. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

13. Links to Other Sites

Articles may link to third-party websites, products, and sponsors. We are not responsible for their privacy practices. Read their policies before providing any information.

14. Changes to This Policy

We may update this Policy from time to time. We will post the new version here with a new "Last updated" date. Material changes to how we use your email or mobile information will be announced by email or text before they take effect.
